INTRODUCTION

These SMS Terms & Conditions govern the use of text messaging services offered by Dream State Investments LLC, doing business as Be Abundant. By opting into our SMS communications, you agree to the policies, rights, obligations, disclosures, and consent requirements described in this document. These Terms apply to all individuals who enroll in or receive text messages from Be Abundant, including promotional messages, appointment reminders, alerts, confirmations, community updates, and automated workflow communications.

Your participation in Be Abundant’s SMS program signifies your express consent to receive text messages from the phone numbers we use for communication. These messages may be sent using automated technology, and your consent represents an agreement that such messages may legally be delivered to the telephone number you provide.

If at any time you do not agree with these Terms, you may discontinue participation by replying “STOP” to any message.

PROGRAM DESCRIPTION

Be Abundant uses SMS and MMS messaging to deliver appointment reminders, confirmation notices, coaching prompts, community updates, motivational messages, marketing promotions, digital product updates, event reminders, and workflow-driven communication related to our programs and services. Messages may include both transactional content necessary to operate our services and promotional content designed to inform you about services, offers, updates, or opportunities.

Message frequency may vary depending on your interaction with our website, programs, or CRM system. You may receive recurring automated messages as part of certain coaching workflows, lead nurturing sequences, and digital product delivery paths.

Participation in our SMS program is voluntary, and message delivery depends on your mobile carrier, device capabilities, geographic location, and network availability. Be Abundant is not responsible for delayed or undelivered messages.

USER OPT-IN AND CONSENT

OPT-OUT AND UNSUBSCRIBE INSTRUCTIONS

You may opt out of the Be Abundant SMS program at any time by replying “STOP,” “END,” “UNSUBSCRIBE,” “CANCEL,” or “QUIT” to any message you receive. When you send one of these keywords, you will receive a confirmation message indicating that you have been unsubscribed. After confirmation, no further messages will be sent unless you re-opt-in voluntarily.

Unsubscribing from SMS does not remove you from email communications. To unsubscribe from email, you must use the email unsubscribe link provided.

If you want to resume SMS messages after opting out, you may reply “START” or re-submit your phone number through any Be Abundant opt-in form.

Although Be Abundant strives to ensure timely delivery of all SMS communications, delivery is not guaranteed. Message delays, failures, or interruptions may occur due to mobile carrier limitations, network congestion, device issues, geographic restrictions, or third-party service outages.

Be Abundant is not responsible for any delays, message delivery failures, or technical issues caused by carriers or third-party SMS platforms.

CARRIER LIABILITY DISCLAIMER

Carriers such as AT&T, Verizon, T-Mobile, Sprint (legacy), and others are not liable for delayed or undelivered messages sent through the Be Abundant SMS program. Message transmission is dependent on the technology and networks of these carriers, and no guarantee can be made regarding message stability, availability, performance, accuracy, or reliability.

Carriers do not endorse the services or content provided by Be Abundant.

PROGRAM TERMINATION OR MODIFICATION

Be Abundant reserves the right to modify, suspend, or terminate the SMS program at any time without prior notice. Participation in the program does not guarantee future availability of SMS services or message continuity.

Be Abundant may adjust message frequency, communication content, automation sequences, or the technology used to operate the program at its discretion.

USER RESPONSIBILITIES

You agree to provide accurate and up-to-date information when opting into SMS communications. You are responsible for notifying Be Abundant of any changes to your phone number or mobile device. If you transfer, disconnect, or reassign your number, you must opt out and re-opt-in using your new number.

You acknowledge that SMS messages may be readable by anyone who has access to your mobile device. You are solely responsible for safeguarding the confidentiality of any information received via text.

You agree not to initiate fraudulent opt-in behavior, misuse SMS services, send abusive replies, attempt to hack or manipulate automated messaging systems, or violate any federal or state telecommunication regulations.

These SMS Terms & Conditions are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located within Texas, and you consent to personal jurisdiction within that venue.
